Complexity of the Debate on Electoral Reforms in El Salvador

Magistrate Alfredo Juncá Wendehake of the Electoral Tribunal warned of the risks of adopting legally imprecise norms that could lead to conflicts. He also opposed the cancellation of the right for party members to sign for independent candidates, noting that the new multi-member district voting system complicates the electoral process.

Electoral reforms are in their final block of discussion, and the vote in multi-member districts is just a sample of how complex the debate will be. He insisted on the need for coherence with the rest of the electoral legal framework. Juncá reiterated the risks of approving electoral norms without legal precision, as these not only regulate procedures but also directly impact citizen confidence and the stability of the democratic system. The magistrate, in previous statements, was against prohibiting citizens registered in political parties from signing the validation of independent candidacies. Instead, the lists of independent candidacies are eliminated, and the citizen's vote will be the same as the current one, that is, they will only be able to vote for one candidate of free nomination. The magistrate of the Electoral Tribunal, Alfredo Juncá Wendehake, warned that any imprecise drafting can open the door to contradictory interpretations and future conflicts. The discussion of Article 424 of the Electoral Code took the entire month of January, including three weeks of analysis for its approval. The statements come after the approval this Thursday of a new form of voting in multi-member districts that allows voting for more than one candidate from a political party.
